Mother alleges minor son was burned during procedure at Cabell Huntington Hospital

HUNTINGTON – A Logan County mother alleges her son was burned by a surgical instrument during a procedure at Cabell Huntington Hospital.

Misty Chapman, as the parent of Zachary Chapman, a minor filed a complaint Jan. 3 in Cabell Circuit Court against Viorel Raducan MD, Marshall University Board of Governors and Cabell Huntington Hospital Inc. alleging deviation of the standard of care.

According to the complaint, the plaintiff alleges that on Nov. 27, 2015, Zachary Chapman suffered a severe burn to his hip, permanently scarring him, when Raducan placed a hot surgical instrument on the operating table next to him during a surgical procedure.

The plaintiff holds Raducan, Marshall University Board of Governors and Cabell Huntington Hospital Inc. responsible because the defendants failed to document the existence of the burn wound, did not provide treatment for the burn nor provided medication or instructions for the care of the burn.

The plaintiff requests a trial by jury and seeks specific and general damages, pre- and post-judgment interest and all other available relief. She is represented by Stuart Calwell and David H. Carriger of The Calwell Practice PLLC in Charleston. The case has been assigned to Circuit Judge Paul T. Farrell.
