IRS employee claims ThyssenKrupp Elevator was negligent in elevator maintenance

PRINCETON – A Princeton woman employed by the Internal Revenue Service in Beckley alleges an elevator caused her to fall.

Gale Lynn Whitt filed a complaint Jan. 10 in Mercer Circuit Court against ThyssenKrupp Elevator Corp. alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 23, 2016, she was a passenger in one of defendant's elevators in the federal building while on break. She alleges the elevator stopped a few inches above the floor in the building and the change in elevation caused her to lose her balance and fall.

She alleges she sustained severe and permanent injuries to her right knee, neck and back. 

The plaintiff holds ThyssenKrupp Elevator Corp. responsible because the defendant allegedly was negligent in failing to property design, inspect, service and repair its elevators in good working condition.

The plaintiff requests a trial by jury and seeks compensatory damages, pre- and post-judgment interest, costs of court and such other just and proper relief. She is represented by Jerad K. Horne of Brewster, Morhous, Cameron, Caruth, Moore, Kersey & Stafford PLLC in Bluefield. The case has been assigned to Circuit Judge Derek C. Swope.
