Man alleges Stonemor Partners wrongfully terminated him

LOGAN – A Logan County man alleges he lost his job because of a workplace injury.

Rickey A. Vance filed a complaint Jan. 12 in Logan Circuit Court against the Stonemor Partners LP and Mark Nelson alleging violation of the West Virginia Human Rights Act, wrongful termination and other counts.

According to the complaint, the plaintiff alleges that he was injured while working for the defendants on Nov. 15, 2017. He alleges he filed a claim for workers' compensation benefits, was removed from working by the Charleston Area Medical Center and was to return to light duty work on Jan. 3. 

The plaintiff alleges on Dec. 8, 2017, he was terminated from his employment while he was off of work because of the injury.

The plaintiff holds Stonemor Partners LP and Nelson responsible because the defendants allegedly discriminated against him by terminating his employment due to his disability and for attempting to receive workers' compensation benefits.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, pre- and post-judgment interest, costs, attorney's fees and such other just and proper relief. He is represented by Nathan D. Brown and Joshua S. Ferrell of Ferrell & Brown PLLC in Williamson. The case has been assigned to Circuit Judge Joshua Butcher.
