Pedestrian alleges DC LLC served alcohol to underage driver

MORGANTOWN – A pedestrian is seeking damages from multiple individuals after an allegedly intoxicated driver caused her injuries.

Madeleine E. Wymer filed a complaint Jan. 12 in Monongalia Circuit Court against Alexander Salvatore Hambrick, Kimberly Hambrick, Brad Hambrick, DC LLC, Michael S. Schuman and Thomas H. Vanlandingham alleging negligence.

According to the complaint, the plaintiff alleges that on Jan 17, 2016, defendant Alexander Hambrick struck and killed another pedestrian walking down the street with plaintiff, who alleges she incurred physical and mental injuries as a result. 

The plaintiff holds Alexander Salvatore Hambrick, Kimberly Hambrick, Brad Hambrick, DC LLC, Michael S. Schuman and Thomas H. Vanlandingham responsible because Kimberly and Brad Hambrick negligently entrusted their vehicle to an irresponsible driver with a tendency to drink alcohol and drive, and defendants DC LLC, Schuman and Valandingham negligently sold alcoholic drinks to defendant Alexander Hambrick, who was younger than 21.

The plaintiff seeks compensatory and punitive damages, attorney's fees, costs and expenses and all further relief as the court deems just. She is represented by Michael J. Del Giudice of Ciccarello, Del Giudice and LaFon in Charleston.
