BECKLEY – An Oak Hill woman alleges her late brother was not provided actual treatment for his mental illness before he committed suicide.
Laura Jane Kinciad, in her capacity as administratrix of the estate of John Pat Maroney, deceased filed a complaint Jan. 12 in Raleigh Circuit Court against Appalachian Regional Healthcare Inc., Joseph Obiajulu Nnadike and Jennifer Lambert ARNP alleging negligence.
According to the complaint, the plaintiff alleges that on Dec. 19, 2015, Maroney received emergency medical treatment from Nnadike and Lamber at Beckley Appalachian Regional Hospital. The suit states Maroney was expressing suicidal ideations with a recent history of hallucinations and that he was discharged the same day instead of being admitted for in-patient care and treatment. Maroney later committed suicide on Dec. 20, 2015, the suit states.
The plaintiff holds Appalachian Regional Healthcare Inc., Nnadike and Lambert responsible because the defendants allegedly failed to provide decedent with formal psychiatric consultation and negligently discharged him without actual treatment or a development of a care plan.
The plaintiff requests a trial by jury and seeks compensatory damages, plus interest as well as all other relief that the court may deem fair and just. She is represented by John J. Mize of Mize Law Firm PLLC in Beckley. The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
