HUNTINGTON – A Huntington man alleges he has been damaged by the denial of disability benefits.
Noel Jordan filed a complaint on Jan. 26 in the U.S. District Court for the Southern District of West Virginia against AT&T Integrated Disability Service Center Disability Plan, Sedgwick Claims Management Services Inc. and Does 1 through 5 citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that he suffered from major depressive disorder and applied for short-term disability benefits in April 2016. The suit states that his claim was denied the following month and he appealed, and benefits were awarded from April 2016 to May 2016. The suit states he again appealed the denial of benefits beyond May 2016.
The plaintiff holds AT&T Integrated Disability Service Center Disability Plan, Sedgwick Claims Management Services Inc. and Does 1 through 5 responsible because the defendants decision to deny his benefits is allegedly not supported by substantial evidence.
The plaintiff seeks order the defendants to pay the plaintiff all short-term and long-term disability benefits due under the plan, monetary judgment for all sums owed to the plaintiff, interest, court costs and any further relief the court grants.
