Catalyst Refiners Inc. alleged to have failed to accommodate former employee's disability

CHARLESTON – A Boone County man alleges he was terminated by his Kanawha County employer because of his disability.

Nicholas Workman filed a complaint Jan. 29 in Kanawha Circuit Court against Catalyst Refiners Inc., Timothy Roush, Eddie Lovejoy and Bill Kidd alleging disability discrimination and a failure to accommodate.

According to the complaint, the plaintiff worked for the defendants as a plant worker. He alleges he was diagnosed with a hernia and his doctor informed him that he should not lift heavy objects at work. He alleges he told the defendants about these restrictions and they refused to accommodate him and he was eventually terminated.

The plaintiff holds Catalyst Refiners Inc., Roush, Lovejoy and Kidd responsible because the defendants allegedly refused plaintiff's request for proper accommodation for his disability.

The plaintiff requests a trial by jury and seeks damages, lost wages and benefits, back pay, front pay, punitive damages, interest, court costs and any further relief the court grants. He is represented by Paul L. Frampton Jr. of Atkinson & Polak PLLC in Charleston and Matthew M. Hatfield of Hatfield & Hatfield PLLC in Madison. The case has been assigned to Circuit Judge Charles E. King.
