Consumer claims Chevrolet Camaro has defects, doesn't conform to warranties

CHARLESTON – A Kanawha County consumer alleges a vehicle she purchased has defects and is seeking cancellation of the sales contract.

Bridget Miller Saunders filed a complaint Jan. 29 in Kanawha Circuit Court against General Motors LLC and Joe Holland Chevrolet Inc. alleging that they violated the Magnuson-Moss Warranty Act and other counts.

According to the complaint, the plaintiff alleges that on May 31, 2017, she purchased a 2017 Chevrolet Camaro from Joe Holland Chevrolet Inc. After purchase, she alleges she experienced non-conformities with the Camaro that substantially impaired its use, value and safety. As a result, she claims she suffered monetary loss, emotional distress, annoyance, inconvenience and loss of use of the vehicle. 

The plaintiff holds General Motors LLC and Joe Holland Chevrolet Inc. responsible because the defendants allegedly sold her a new motor vehicle that did not conform to its warranties and despite numerous attempts to repair it, the defendants and failed to conform it to its warranties.

The plaintiff requests a trial by jury and seeks cancellation or revocation of acceptance, award for all damages, statutory penalties, interest and such other and further relief that are appropriate.
