Putnam County consumers accuse local contractor of fraud

WINFIELD – A Scott Depot couple alleges a Putnam County business used funds meant for a home's construction for another use.

James Mason and Monica Mason filed a complaint Jan. 4 in Putnam Circuit Court against Howard Gregory and T.V.B. Inc. alleging violation of the West Virginia Consumer Credit Protection Act, fraud and other counts.

According to the complaint, the plaintiffs allege that on March 28, 2017, they contracted defendants to build their home for a total price of $509,310. They allege the defendants did not use their money to purchase materials but instead used it for their own purpose. As a result, the suit states material men and subcontractors are in the process of filing liens against the property.

The plaintiffs holds Howard Gregory and T.V.B. Inc. responsible because the defendants allegedly fraudulently induced the plaintiffs to enter into a contract with them and billed them for materials that were not used in the construction of their house.

The plaintiffs request a trial by jury and seek actual, incidental and punitive damages, attorney's fees, costs, pre- and post-judgment interest and such other just and appropriate relief. They are represented by Kevin W. Hughart of Hughart Law Office in Sissonville. The case has been assigned to Circuit Judge Joseph Reeder.
