Ohio County Development Authority seeks damages over masonry work at Marquee Cinemas building

WHEELING – The owner of The Highlands mall complex claims that it has incurred remediation costs because of improper masonry work at a building in the complex.

Ohio County Development Authority filed a complaint Jan. 8 in Ohio Circuit Court against Cost Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Jan. 1, 2008, the plaintiff contracted defendant for the construction masonry work on its Marquee Cinemas building at The Highlands mall complex. The plaintiff alleges that the building has incurred unusual and excessive wall and cement floor cracking and vertical control joint expansion.

The plaintiff holds Cost Co. responsible because the defendant allegedly failed to provide a qualified representative to receive the specified masonry blocks and concrete and to reject uncured ones and failed to advise plaintiff of the consequence of installing uncured blocks.

The plaintiff requests a trial by jury and seeks actual, consequential and compensatory damages, pre- and post-judgment interest, attorney's fees, costs and all other relief as permitted by law. It is represented by Donald J. Tennant Jr. of Tennant Law Offices in Wheeling.
