WHEELING – A man allegedly injured in a collision with an intoxicated driver is seeking damages from his insurer.
Russell Thompson filed a complaint on Jan. 12 in Ohio Circuit Court against State Farm Mutual Automobile Insurance Co. alleging that the liability insurer failed to fulfill its obligations under the insurance contract.
According to the complaint, the plaintiff alleges that on Jan. 21, 2017, he was injured in a motor vehicle collision caused by the carelessness of Jeff Brock, who was under the influence of alcohol. The plaintiff alleges he suffered injuries and damages and incurred medical expenses of more than $6,700.
The plaintiff holds State Farm Mutual Automobile Insurance Co. responsible because the defendant allegedly failed to settle plaintiff's underinsurance claim.
The plaintiff requests a trial by jury and seeks judgment against the defendant in a fair amount based upon plaintiff's damages. He is represented by Joseph J. John and Anthony I. Werner of John & Werner Law Offices PLLC in Wheeling. The case has been assigned to Circuit Judge James P. Mazzone.
