WHEELING – A consumer alleges a Dodge pickup truck he purchased has a defective transmission and is seeking rescission of the sales contract.
James P. Loughery Jr. filed a complaint Jan. 12 in Ohio Circuit Court against FCA US LLC alleging that the automobile manufacturer violated the Magnuson-Moss Warranty Improvement Act.
According to the complaint, the plaintiff alleges that on April 2, 2016, he purchased defendant's 2016 Ram 3500 for $47,286.75. After purchase, he alleges he experienced serious non-conformities with the vehicle's transmission that substantially impaired its use, value and safety.
The plaintiff holds FCA US LLC responsible because after numerous attempts to repair the vehicle, the defendant allegedly failed to conform it to its warranties.
The plaintiff requests a trial by jury and seeks rescission of the contract, incidental and consequential damages, attorney's fees, costs and such other relief that is just and appropriate. He is represented by Christina Gill Roseman of Roseman Law Firm PLLC in Pittsburgh, Pennsylvania.
