PRINCETON – The owner of a Bluefield property alleges her insurer breached their contract when it refused to pay for water damage to the property.
Kathleen Crickmer filed a complaint on Jan. 17 in Mercer Circuit Court against Allstate Insurance Co. alleging that the licensed insurer violated the West Virginia Unfair Trade Practices Act.
According to the complaint, the plaintiff alleges that on Jan 12, 2017, her insured property was seriously damaged by water, for which she promptly notified defendant of the damage and made a proper claim for the insurance coverage and benefits.
The plaintiff holds Allstate Insurance Co. responsible because the defendant allegedly refused to pay the full and complete coverage and benefits to which she is entitled under the insurance policy.
The plaintiff requests a trial by jury and seeks an order to enforce the insurance contract, award for damages, pre- and post-judgment interest, attorney's fees, costs and expenses. She is represented by William S. Winfrey II in Princeton. The case has been assigned to Circuit Judge Mark Wills.
