BECKLEY – A Fayette County woman alleges her decedent died prematurely because of a delay in treatment of his condition.
Doris Bowles, administratrix of the estate of Clinard Bowles Jr., filed a complaint Jan. 29 in Raleigh Circuit Court against Herbert Oye, DO and Appalachian Regional Healthcare Inc., doing business as Beckley ARH Hospital, alleging deviation from the standard of care.
According to the complaint, the plaintiff alleges that on June 18, 2016, Clinard Bowles Jr. presented to the defendants with complaints of chest pain, abdominal pain and confusion. The suit states he died during transport to the Charleston Area Medical Center on June 20, 2016.
The plaintiff holds Oye and Appalachian Regional Healthcare Inc. responsible because the defendants allegedly failed to properly diagnose Clinard Bowles Jr.'s thoracic aortic dissection after tests performed on June 18. 2016, resulting in a delay in treatment.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, funeral expenses, benefits, economic and noneconomic damages and court costs and interests. She is represented by Ben Salango and Patrick Salango of Preston & Salango PLLC in Charleston. The case has been assigned to Circuit Judge John A. Hutchison.
