Mardi Gras Casino and Resort patron allege track lights on floor caused injuries

CHARLESTON – A Kanawha County woman alleges she was injured at a Nitro casino and needed surgery afterward.

Nittaya Gallagher filed a complaint Jan. 30 in Kanawha Circuit Court against Racing Corp. of West Virginia, doing business as Mardi Gras Casino and Resort, alleging negligence.

According to the complaint, the plaintiff alleges that on March 8, 2017, she sustained physical injuries when she tripped and fell over a raised set of track lights on the floor at the defendant's premises. She alleges she sustained a hip injury that later needed surgery.

The plaintiff holds Racing Corp. of West Virginia responsible because the defendants allegedly failed to discover the hazardous condition or failed to remediate it.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount sufficient to compensate the plaintiff for her damages, court costs, interest, interest and any further relief the court grants. She is represented by Scott H. Kaminski of Kaminski Law PLLC in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
