Woman alleges Toro mower is defective, injured her in crash

NEW CUMBERLAND – A Weirton woman alleges she was injured because of a defective lawnmower.

Carol Hrabovsky filed a complaint Jan. 31 in Hancock Circuit Court against The Toro Co. and John Does.

According to the complaint, the plaintiff purchased the defendants' eXmark Toro lawnmower on July 11, 2017. She alleges on July 13, 2017, the lawnmower malfunctioned and crashed, injuring her. Further details of what happened or her injuries are not included in the complaint.

She says she didn't modify or misuse the mower, and she says didn't cause the malfunction.

The plaintiff holds The Toro Co. and John Does, responsible because the defendants allegedly failed to design and assemble a properly functioning and defect-free product and designing a defective product that malfunctioned and crashed.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, interest, court costs and any further relief the court grants. She is represented by Vincent S. Gurrera of Vurrera Law Offices PLLC in Weirton. The case has been assigned to Circuit Judge James P. Mazzone.
