Alford Home Solution alleged to have terminated man over commission rate complaints

CHARLESTON – A Scott Depot man claims a St. Albans employer failed to compensate him at the commission percentage promised.

John C. Mawyer filed a complaint Jan. 31 in Kanawha Circuit Court against Alford Home Solution Inc. alleging breach of contract and wrongful termination.

According to the complaint, the plaintiff alleges while an employee of the defendant, he had a commission-based compensation agreement and was to receive a flat 10 percent commission upon the gross sale price of a successful transaction. He alleges the defendant paid him less than 10 percent and when he complained of the breach of agreement, he was terminated.

The plaintiff requests a trial by jury and seeks actual damages, punitive damages, court costs and any further relief the court grants. He is represented by O. Gay Elmore Jr. of O. Gay Elmore Jr. Attorney at Law in Charleston. The case has been assigned to Circuit Judge Louis H. Bloom.
