Family Dollar shopper alleges wooden chest fell on her, caused injuries

WHEELING – A shopper at a Wheeling Family Dollar store alleges she was injured when a chest that was part of a display fell on her.

Connie Pierson filed a complaint Feb. 2 in Ohio Circuit Court against Family Dollar Stores of West Virginia LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 4, 2016, she was lawfully on the premises of the defendant when a wooden chest fell off a shelf and hit plaintiff's neck and right arm. 

The plaintiff holds Family Dollar Stores of West Virginia LLC responsible because the defendant allegedly failed to alert plaintiff of the dangerous condition and failed to properly inspect, repair, maintain, monitor and remedy the dangerous condition.

The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory damages, plus interest, costs, attorney's fees, and other relief as the court deems just. She is represented by Jacob M. Robinson of Robinson Law Offices in Wheeling. The case has been assigned to Circuit Judge Jason Cuomo.
