Bluefield man alleges sewage backup caused more than $20,000 in structural damage

PRINCETON – A Bluefield man is suing the city's sanitary board after sewage backed up into his home and allegedly damaged his property.

Jerome Walker filed a complaint Feb. 8 in Mercer Circuit Court against The Bluefield Sanitary Board alleging negligence.

According to the complaint, the plaintiff owns a property on Vencil Street and has sewer services provided by the Bluefield Sanitary Board. He alleges he reported a blockage in the sewer line that prevent sewage from properly leaving his residence in October 2017 and due to the delay in locating in clearing the blockage, sewage repeatedly backed up into his home.

The plaintiff alleges he suffered damages in the amount of $23,361.43 to his structure in additional to personal property damages.

The plaintiff holds The Bluefield Sanitary Board responsible because the defendant allegedly failed to conduct a reasonable investigation in a timely manner and failed to immediately remove blockage in the main line.

The plaintiff requests a trial by jury and seeks interest, attorney's fees, costs, and other relief as the court may deem proper. He is represented by Harold B. Wolfe III in Princeton. The case has been assigned to Circuit Judge Mark Wills.
