Employee alleges State Electric Supply terminated him in retaliation

Wrongful term 03

BECKLEY – A Raleigh County company is alleged to have terminated a Fayette County man in retaliation for filing a workers' compensation claim.

Chad G. Tyree filed a complaint Feb. 9 in Raleigh Circuit Court against State Electric Supply Co. alleging discrimination and workers' compensation retaliation.

According to the complaint, the plaintiff was employed by the defendant at its Beckley location on May 28, 2017, and was injured. He alleges he filed a claim for workers' compensation benefits and gave a light duty note from his doctor to the defendant. He alleges when he presented the note, he was fired.

The plaintiff holds State Electric Supply Co. responsible because the defendant allegedly retaliated against the plaintiff over his workers' compensation claim.

The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory and punitive damages. He is represented by Greg A. Hewitt of Hewitt & Salvatore PLLC in Fayetteville. The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
