Homeowners file fraud suit against Lewis and Ark Builders over work

BECKLEY – A Raleigh County couple alleges a Beckley company performed subpar work on their home.

Robert Day and Patricia Day filed a complaint Feb. 14 in Raleigh Circuit Court against Lewis and Ark Builders LLC alleging breach of contract and fraud.

According to the complaint, the plaintiffs hired the defendant in October 2016 to do major home repairs or remodeling on their home. The plaintiffs allege the defendant has failed to complete the work as promised.

The plaintiffs hold Lewis and Ark Builders LLC responsible because the defendant allegedly breached their contractual agreement with the plaintiffs by failing to complete the work in a timely manner and to the standards agreed to.

The plaintiffs seek compensatory damages, any additional damages, punitive damages, court costs, interest and any further relief the court grants. They are represented by J. Mingo Winters of J. Mingo Winters in Beckley. The case has been assigned to Circuit Judge Robert A. Burnside Jr.
