Woman alleges Logan Mingo Area Mental Health termianted her after taking leave for funeral

LOGAN – A Chapmanville woman alleges she was terminated for visiting a dying family member and to attend her funeral.

Tony Ferrell and Tabatha Ferrell filed a complaint Feb. 15 in Logan Circuit Court against Logan Mingo Area Mental Health Inc. alleging that the domestic corporation violated the West Virginia Human Rights Act.

According to the complaint, Tabatha Ferrell was employed by the defendant as a behavioral health technician. On Nov. 16, 2017, the suit states her immediate family member was hospitalized in critical condition and she called off of her shift. The family member passed away Nov. 18, 2017, and the suit states Tabatha Ferrell was terminated Nov. 20, 2017.

The plaintiffs hold Logan Mingo Area Mental Health Inc. responsible because the defendant's conduct allegedly was malicious, intentional and in reckless disregard of plaintiff's protected rights.

The plaintiffs request a trial by jury and seek compensatory and punitive damages, pre- and post-judgment interest, attorney's fees, costs and such other just and equitable relief. They are represented by Steven S. Wolfe and J. Christopher White of Wolfe, White & Associates in Logan. The case has been assigned to Circuit Judge Joshua Butcher.
