Cherry River Construction alleges it is owed more than $180,000 for work on Wal-Mart projects

PRINCETON – A subcontractor alleges it wasn't paid in full for work it completed on projects for Wal-Mart.

Cherry River Construction LLC filed a complaint Feb. 15 in Mercer Circuit Court against Wal-Mart Stores Inc. citing a mechanic's lien claim and implied contract.

According to the complaint, the plaintiff was a subcontractor to Variety Contractors, which was hired by the defendant for its fuel station projects in Weston, Hurricane, Mason and Elkins. The plaintiff alleges it performed and completed all work as outlined by the contracts and that the defendant and Variety failed to pay it the full amount due and owing.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the sum of $187,047.63, prejudgment interest and such other just and proper relief. It is represented by Carl J. Roncaglione Jr. of Carl J. Roncaglione Jr. Law Office in Charleston. The case has been assigned to Circuit Judge William J. Sadler.
