Couple seeks underinsured motorist benefits from Nationwide Mutual Insurance

WHEELING – A couple alleges their insurer breached their contract by failing to provide underinsured motorist benefits.

Wilbur F. Wilson Jr. and Norma L. Wilson filed a complaint Feb. 16 in Ohio Circuit Court against John Hinzey and Nationwide Mutual Insurance Co. alleging breach of contract.

According to the complaint, Wilbur F. Wilson Jr. was stopped in his pickup truck on the exit ramp of Interstate 70 East in Wheeling when he was struck by Hinzey's vehicle on Feb. 19, 2016. He alleges the collision caused him injuries and to incur medical expenses.

The plaintiffs allege they made a timely and proper underinsured motorist claim for benefits with the defendant Nationwide, their insurer. 

The plaintiffs holds Hinzey and Nationwide Mutual Insurance Co. responsible because defendant Nationwide allegedly failed to provide underinsured motorist coverage benefits adequate to fully compensate them for their injuries, damages and losses.

The plaintiffs request a trial by jury and seek judgment against defendant Nationwide for all the benefits due to them, pre- and post-judgment interest, attorney's fees, costs and such other just and proper relief. They are represented by Eric M. Gordon of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville.
