Beneficiary claims Boone County woman withheld aunt's assets

LOGAN – A South Carolina man alleges a Boone County woman wrongfully obtained and withheld assets owned by his late aunt.

James R. Richmond filed a complaint Feb. 20 in Logan Circuit Court against Katherine L. Dolin, individually and as executrix of the estate of Jeanell A. McCormick, et al. alleging constructive fraud, conversion and other counts.

According to the complaint, Jeanell A. McCormick died in June 2017 and was a resident of Logan County and owned real estate there. The plaintiff alleges he is a beneficiary of the estate and had an expectancy to inherit assets from the estate.

The plaintiff holds Dolin, individually and as executrix of the estate of Jeanell A. McCormick, et al. responsible because defendant Dolin allegedly induced McCormick to convert her personal assets into assets in the name of both her and Dolin and interfered with the plaintiff's expectancy to inherit additional assets.

The plaintiff requests a trial by jury and seeks an order removing defendant Dolin as executrix, award for all damages, interest, attorney's fees, costs and such other just and proper relief. He is represented by Andrew L. Ellis of Wooton, Davis, Hussell & Ellis PLLC in Charleston. The case has been assigned to Circuit Judge Paul M. Blake Jr.
