Pedestrian alleges bolt in Huntington sidewalk caused fall

HUNTINGTON – A pedestrian alleges he was injured while walking on a Huntington sidewalk because of a bolt.

Don Handley filed a complaint in Cabell Circuit Court against the city of Huntington alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 13, 2013, he was walking on a sidewalk within the dominion and control of defendant when he tripped over a raised bolt in the sidewalk. 

The plaintiff holds the city of Huntington responsible because the defendant allegedly failed to correct the condition or warn the plaintiff of the hazard.

The plaintiff seeks compensatory and consequential damages, prejudgment and post-judgment interest and costs expended herein. He is represented by Scott G. Stapleton in Huntington. The case has been assigned to Circuit Judge Gregory L. Howard Jr.
