CHARLESTON – A nurse at William R. Sharpe Jr. Hospital in Weston alleges she was attacked by a patient and has been unable to work.

Amy Clemons filed a complaint in Kanawha Circuit Court against SHC Services Inc., Jane Doe, et al. alleging negligence.

According to the complaint, Doe is an incompetent person that was under the care of the state and was confined to William R. Sharpe Jr. Hospital on involuntary commitment because of mental health issues. The plaintiff alleges that on Feb. 10, 2016, she was attacked by defendant Jane Doe and sustained physical injuries that have prevented her from working since.

The plaintiff holds SHC Services Inc., Jane Doe, et al. responsible because Doe allegedly attacked the plaintiff and other staff members and SHS Services permitted the existence of an unsafe working condition.

The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly and severally, in an amount to be proven at trial, with interest and all other damages that may be recovered from this action. She is represented by David A. Sims of Law Offices of David A. Sims PLLC in Vienna. The case has been assigned to Circuit Judge James C. Stucky.
