Woman alleges attack by patient at Weston hospital caused by negligence

CHARLESTON – A Randolph County woman alleges that she was injured by an involuntarily committed patient at a Weston hospital.

Lisa Phillips Simmons filed a complaint in Kanawha Circuit Court against SHC Services Inc., Jane Doe, et al. alleging negligence and deliberate intent.

According to the complaint, the plaintiff alleges that on April 15, 2016, she suffered severe physical injuries when she was attacked by defendant Jane Doe, an incompetent person. The suit states Doe was ordered to be confined at William R. Sharpe Jr. Hospital on an involuntary commitment because of mental health issues. Due to her injuries, the plaintiff alleges she was prevented from working for an extended period of time. 

The plaintiff holds SHC Services Inc., Jane Doe, et al. responsible because defendants SHC and Doe corporations allegedly failed to provide sufficient staff to the facility and failed to provide adequate supervision to avoid injuries to members of the William J. Sharpe Hospital's staff.

The plaintiff seeks judgment against the defendants, jointly and severally, in an amount to be proven at trial, with interest and all other damages that may be recovered from this action. She is represented by David A. Sims of Law Offices of David A. Sims PLLC in Vienna. The case has been assigned to Circuit Judge Jennifer F. Bailey.
