WW Consultants alleges it is owed more than $950,000 for Pocahontas County project

CHARLESTON – An engineering corporation alleges it was not compensated for its work on a Pocahontas County project.

WW Consultants Inc. filed a complaint in Kanawha Circuit Court against Pocahontas County Public Service District, et al., alleging breach of contract and other counts.

According to the complaint, the plaintiff and Pocahontas County Public Service District entered into a contract in January 2011 for design and consulting services for a new waste water treatment plant. It alleges that issues arose with the project and that it was not compensated for the additional costs it incurred for preparing the facility's plan and design services, for all delays caused by the defendants and for all worked requested beyond the scope of the agreement. 

The plaintiff seeks an order to transfer the remaining balance of the contingency fund to a special receiver, award for damages in the amount of $956,856.13, with interest, costs and all other damages deemed appropriate. It is represented by Nathaniel K. Tawney and Keith R. Hoover of Flaherty Sensabaugh Bonasso in Charleston. The case has been assigned to Circuit Judge Louis H. Bloom.
