Patient of Kanawha County doctor alleges bypass surgery was not needed

CHARLESTON – A Kanawha County physician is alleged to have performed unnecessary heart surgery on a patient.

Connie West filed a complaint in Kanawha Circuit Court against Edmundo E. Figueroa, MD, citing the West Virginia Medical Professional Liability Act.

According to the complaint, the plaintiff alleges that on Sept. 24, 2014, she underwent coronary bypass surgery performed by defendant that he had previously recommended. In the last quarter of 2016, the suit states it was determined by other health care professionals that a blockage did not exist in the plaintiff's artery and no bypass was necessary. As a result, she alleges she was required to undergo additional surgical procedures. 

The plaintiff holds Figueroa responsible because the defendant allegedly breached the standard of care.

The plaintiff requests a trial by jury and seeks judgment against the defendant for all damages as permitted by law and all other relied to which she is entitled. She is represented by Arden J. Curry II and David K. Schwirian of Pauley Curry PLLC in Charleston. The case has been assigned to Circuit Judge James C. Stucky.
