Pedestrian alleges West Virginia-American Water meter cover caused fall

CHARLESTON – An Elkview woman alleges she was injured while crossing a street in Charleston because of a water meter cover.

Kelly Goddard filed a complaint in Kanawha Circuit Court against West Virginia-American Water Co. alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 8, 2016, she was preparing to cross Maryland Avenue in Charleston when she fell due to an unsafe condition created by the defendant's water meter cover on the ground. She alleges she received serious and permanent injuries to her right leg, left foot, right knee, back, shoulders and arms as a result of the fall.

The plaintiff holds West Virginia-American Water Co. responsible because the defendant allegedly should have known that the meter cover needed to be maintained in a safe fashion.

The plaintiff requests a trial by jury and seeks judgment against the defendant for all damages, prejudgment interest, costs and all other relief that is proper and just. She is represented by Kevin P. Davis in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
