Consumer accuses reporting agencies of erroneous credit report

CHARLESTON — A Charleston woman is suing consumer reporting agencies, alleging an erroneous credit report.

Tonya M. Bailey filed a complaint Feb. 16 in Kanawha Circuit Court against Trans Union LLC and Equifax Information Services LLC, alleging they failed to ensure accurate reporting.

According to the complaint, as a result of the defendants' conduct, Bailey suffered loss of credit, increased insurance and interest rates, mental and emotional pain, humiliation and embarrassment. 

The plaintiff alleges Trans Union and Equifax Information Services failed to conduct a reasonable re-investigation and continued to report her account as charged and in a negative and/or adverse standing.

Bailey seeks trial by jury, actual and punitive damages, statutory penalties, pre- and post-judgment interest, attorney fees, court costs and all other appropriate relief. She is represented by attorneys Sarah K. Brown, Bren J, Pomponio and Daniel F. Hedges of Mountain State Justice Inc. in Charleston.
