Patient accuses Raleigh Co. doctor of negligent treatment

BECKLEY — A patient is suing a Raleigh County doctor, alleging negligent treatment.

Joyce Breeden filed a complaint Feb. 21 in Raleigh Circuit Court against Dr, Jeffrey N. Thaxton, alleging he violated the standard of care within the field of medicine.

According to the complaint, on March 19, 2015, Thaxton performed a bilateral, post-masectomy breast reconstruction on Breeden at Beckley Appalachian Regional Hospital. The suit says on July 17, 2017, Thaxton performed debridement surgery on Breedens' left breast. 

As a result of the defendant's negligent acts, Breeden says she suffered chronic infection, abscess, inflammation and subsequent surgical procedures. The plaintiff alleges Thaxton breached his duty to apply the knowledge, practice, skill and care ordinarily used by a well-qualified health care provider.

Breeden seeks trial by jury, compensatory damages, attorney fees, court costs, pre- and post-judgment interest and all other appropriate relief. She is represented by attorney Timothy P. Lupardus of Lupardus Law Office in Pineville.
