Customer alleges Toyota breached manufacturer warranty

CHARLESTON — A St. Albans customer is suing Toyota, alleging breach of warranty.

Kevin E. Crouch II filed a complaint Feb. 22 in Kanawha Circuit Court against Toyota Motor Sales USA Inc., alleging violation of the West Virginia Consumer Credit & Protection Act.

According to the complaint, on July 27, 2016, Crouch purchased a new 2016 Toyota Tundra SR5 from Moses Toyota/Lexus Inc. for $41,943. Since the purchase, Crouch says, he has taken the car to service representatives at the place of purchase due to numerous defects. 

As a result, the suit says, Crouch has suffered loss of use of the vehicle, annoyance, inconvenience and attorney fees in pursuing legal action. The plaintiff alleges Toyota Motor Sales USA failed to repair the Tundra vehicle to conform it to its warranty.

Crouch seeks trial by jury, full refund of the purchase price, costs of repairs, compensatory damages, pre- and post-judgment interest, attorney fees and all other just and proper relief. He is represented by attorney Clinton W. Smith of Charleston.
