New Martinsville couple alleges insurance carrier failed to cover water damage

MOUNDSVILLE — A New Martinsville couple is suing an insurance company, alleging breach of an insurance contract.

Crystal Rocchio and Joshua Rocchio filed a complaint Feb. 26 in Marshall Circuit Court against Erie Insurance Company and Thomas Paree Agency Inc., alleging failure to cover water damages. 

According to the complaint, on July 5 the Rocchios' insured property in New Martinsville, suffered significant property damage due to a water leak. The plaintiffs say they made a timely claim for damages under the insurance policy issued by Erie. 

As a result of defendants' conduct, however, the suit says the plaintiffs have suffered the loss of use of their home, aggravation, emotional distress and were compelled to retain an attorney to represent their legal interests. 

The plaintiffs allege Erie Insurance and Thomas Paree Agency denied coverage to their home because water damage was not a covered peril under the policy that was issued to the Rocchios

The Rocchios seek trial by jury, all benefits to which they are entitled, compensatory damages, attorney fees, court costs and expenses. They are represented by attorneys Scott S. Blass and Erica A. Cross of Bordas & Bordas PLLC in Wheeling.
