Grafton property buyers accuse radon measurement business of violating EPA rules

GRAFTON — Two Grafton property buyers are suing a radon mitigation company and sellers, alleging breach of contract.

Karis Kline and Daniel Field filed a complaint Feb. 26 in Taylor Circuit Court against Golden Vista Enterprises Inc. Daniel Parsons and Alyssa Parsons, alleging violation of Environmental Protection Agency regulations.

According to the complaint, on Feb. 1, 2017, Kline and Field entered into real estate purchase agreement with the Daniel and Alyssa Parsons, which included radon inspection contingency at a home in Grafton. As a result of the defendants' negligent conducts, the suit says, the plaintiffs suffered a diminution in value of their property and additional cost for radon mitigation and testing. 

The plaintiffs allege the defendants failed to properly mitigate radon issues and wrongfully assured Kline and Field that there was no radon issue at the property.

Kline and Field seek trial by jury, damages for losses sustained by the plaintiffs, attorney fees and court costs. They are represented by attorney William L. Frame of Wilson, Frame & Metheney PLLC in Morgantown.
