KINGWOOD — A Preston County property owner is suing general contractors, alleging breach of duty and breach of warranty.

Dailey (Dale) R. McBride of Bruceton Mills filed a complaint Feb. 27 in Preston Circuit Court against Lowe's of West Virginia Inc., doing business as  Lowe's of Morgantown Inc., et al, alleging they failed to perform work in a good and workmanlike manner.

According to the complaint, McBride hired the defendants to perform work at his home at 225 Golden Road, Bruceton Mills. As a result of defendants' misrepresentations, the suit says, McBride has suffered annoyance and inconvenience in the use of his house.

The plaintiff alleges Lowe's of Morgantown failed to implement proper construction methods and failed to use reasonable care, proper materials and proper supervision in performing work at McBride's residence.

McBride seeks trial by jury, compensatory damages, pre- and post-judgment interest and costs of court. He is represented by attorneys John R. Angotti and David J. Straface of Angotti & Straface LC in Morgantown.
