Mercer County property owners allege bank breached agreement

PRINCETON — Two Mercer County property owners are suing a financial institution, alleging breach of settlement agreement.

Brian K. Whittaker and Terry L. Whittaker filed a complaint Feb. 2 in Mercer Circuit Court against Synchrony Financial, Synchrony Bank, it's wholly owned subsidiary alleging failure to to fulfill contractual obligations.

According to the complaint, as a result of the defendant's wrongful actions and inactions, the Whittakers continue to be harmed due to a recorded lien against their real property and have been forced to retain a lawyer to compel the release of the lien. 

The plaintiffs allege the defendant refuses to provide an executed release judgment.

The Whittakers seek trial by jury, an order directing the clerk of the County Commission of Mercer County to release the lien, attorney fees of $2,000, court costs, expenses and all other proper and just relief. They are represented by attorney Phillip B. Ball of Smith, Lilly & Ball PLLC in Princeton.
