CHARLESTON – Another lawsuit has been filed against Dr. Steven R. Matulis for alleged sexual assault during surgery.
Charleston Gastroenterology Associates PLLC; and Day Surgery Center were also named as defendants in the suit.
J.W. had a surgical procedure done by Matulis in December 2015 and was contacted three months later by law enforcement personnel, when she was told Matulis had engaged in negligent, improper and sexual misconduct during the procedure, according to a complaint filed March 1 in Kanawha Circuit Court.

J.W. claims the acts were witnessed by independent staff.
The defendants did not provide oral or written publication in any manner of material and information to the proper authorities, the public and the plaintiff and her husband, according to the suit.
J.W. claims instead, the defendants provided material and information that was inaccurate and/or omitted material information. The defendants also violated her privacy.
The plaintiff and her husband sustained injury arising out of the defendants’ acts and omissions, according to the suit.
J.W. claims the defendants failed to use reasonable care and were otherwise negligent and failed to keep her safe from unwelcome, hostile and inappropriate conduct.
As a result of the defendants’ failure, J.W. suffered from sexual misconduct, according to the suit.
J.W. claims the defendants had a duty to keep her safe and neglected that duty.
J.W. is seeking compensatory and punitive damages. She is represented by William M. Tiano, Tony L. O’Dell and Cheryl A. Fisher of Tiano O’Dell.
The case is assigned to Circuit Judge Joanna Tabit.
Dozens of lawsuits have been filed against Matulis over the last two years. In May 2016, Matulis switched his medical license to inactive.
