Logan company alleges Kentucky coal mining business owes $94,000

LOGAN — A Logan company is suing a Kentucky coal mining business, alleging breach of contract and owing more than $94,000.

W.W. McDonald Land Company, Wasbold Properties, Inc., R.R. Smith, III, The Frederick F. Stewart Residuary Trust, F. Scott Daniel and Robert E. Daniel filed a complaint in Logan Circuit Court against Greenthorn LLC, alleging failure to pay rent.

According to the complaint, the plaintiffs were damaged financially from not being paid for the lease they've provided Greenthorn for coal mining purposes in the Triadelphia District of Logan County. The plaintiffs allege Greenthorn failed to make timely payments due for the lease.

The plaintiffs seek trial by jury, judgment of $94,118.96, plus interest, court costs, and all further relief the court grants. They are represented by attorney William M. Herlihy of Spilman Thomas & Battle PLLC in Charleston.
