LOGAN — A Logan corporation is suing a Kentucky company, alleging it owes more than $46,000 for breach of contract.
W.W. McDonald Land Company filed a complaint March 7 in Logan Circuit Court against Greenthorn, LLC, alleging the defendant failed to pay tonnage royalties and minimum rentals based on their lease agreement.
According to the complaint, W.W. McDonald was damaged financially due to unpaid royalties, rentals and taxes for the lease it provided to Greenthorn for coal mining purposes.
The plaintiff alleges Greenthorn breached the lease agreement by failing to cure multiple defaults based on the lease.
W.W. McDonald Land seeks trial by jury, judgment of $46,044.10, plus interest, order that the lease be terminated, court costs and all further relief this court grants. It is represented by attorney William M. Herlihy of Spilman Thomas & Battle, PLLC in Charleston.
