Family member accuses St. Mary's of medical negligence

HUNTINGTON — A family member is suing a Huntington health care facility, alleging medical negligence in failing to prevent injuries and death.

Michael Ashworth, as administrator of the estate of Flora Irene Ashworth, filed a complaint March 5 in Cabell Circuit Court against St. Mary's Medical Center, the health care facility negligently deviated from the standards of care. 

According to the complaint, on Feb. 18, 2016, Flora Irene Ashworth came to St. Mary's Medical Center in Huntington due to low hemoglobin and weakness. As a result of defendant's negligent acts, the suit says, Ashworth fell to the floor and suffered a C3-C4 right facet fracture, causing her condition to deteriorate. 

The lawsuit says she died Feb. 9, 2016, and Michael Ashworth suffered loss of solace and mental anguish. 

The plaintiff alleges St. Mary's Medical Center failed to provide the decedent's basic needs, failed to perform safety checks and failed to prevent her from falling.

Ashworth seeks trial by jury, all damages, pre- and post-judgment interest, attorney fees, court costs and all other relief. He is represented by attorneys Robert B. Warner, Lynette Simon and Andrew D. Byrd of Warner Law Offices PLLC in Charleston.
