Tenants blame Raleigh County apartment complex operator for fire

BECKLEY — Two tenants are suing a Raleigh County apartment complex operator, alleging negligence and breach of lease agreement.

Gina Ruth Maynard and Michael Darwine Maynard filed a complaint March 5 in Raleigh Circuit Court against Maplewood LLC, alleging failure to maintain the property in a fit and habitable condition.

According to the complaint,on March 6, 2016, the Maynards were injured when the Maplewood Apartments property they were renting from the defendant caught fire. The suit says they suffered injuries and damages, including smoke inhalation, malaise and fatigue, inconvenience and property damage. 

The plaintiffs allege Maplewood failed to install properly working electrical equipment and smoke detectors and failed to maintain the equipment.

The Maynards seek trial by jury, compensatory, punitive and general damages, pre- and post-judgment interest, attorney fees, court costs and all other just and proper relief. They are represented by attorneys Kyle G. Lusk, Matthew A. Bradford and Brandon L. Gray of Lusk & Bradford PLLC in Beckley.
