Glass museum operator accuses remodeling company of negligence

MOUNDSVILLE — A glass museum operator is suing a remodeling company, alleging breach of contract and negligence.

Fostoria Glass Society of America Inc. filed a complaint March 6 in Marshall Circuit Court against TMK Construction LLC, alleging failure to perform work in a good and workmanlike manner.

According to the complaint, on April 2, 2009, TMK agreed to repair and replace the existing dormers at the plaintiff's Fostoria Glass Museum in Moundsville for $19,680. As a result of defendant's defective work, the suit says, the museum has suffered and will continue to suffer flooding, leaking and other water intrusions

The lawsuit states Fostoria Glass Society was forced to hire a new contractor to repair the roof and dormers for $1,600, but the repairs are temporary. The plaintiff alleges TMK Construction failed to properly repair or reinstall the roof and dormers at the museum.

Fostoria Glass Society of America seeks trial by jury, compensatory damages, costs and disbursement, attorney fees, pre- and post-judgment interest and all other just and equitable relief. It is represented by attorney Christian E. Turak of Gold, Khourey & Turak LC in Moundsville.
