Customer accuses Chevy dealer of deceptive practices

CHARLESTON — A Kanawha County woman is suing is Chevrolet dealer and lender, alleging unfair and deceptive practices.

Lora Poling filed a complaint March 12 in Kanawha Circuit Court against Moses Chevrolet LLC and Santander Consumer USA Inc., alleging violation of the West Virginia Consumer Credit and Protection Act and the Uniform Commercial Code.

According to the complaint, on May 23, 2017, Poling purchased a 2008 Saturn Outlook for personal use from Moses Chevrolet in Kanawha County. The suit says the dealer assured her the vehicle was in "tip top excellent condition" and had just been serviced. After purchase, Poling says she experienced repeated non-conformities with the vehicle that substantially impaired its use, value and safety. 

The plaintiff alleges the defendants materially misrepresented the condition of the vehicle and failed to perform repair work in a good and workmanlike manner to conform the vehicle with its warranties. The suit says the defendants also said repairs would cost $1,800, which Poling refused to pay.

Poling seeks trial by jury, cancellation of the sales contract, all damages, attorney fees, court costs, pre- and post-judgment interest and all other appropriate relief. She is represented by attorneys Kristina Thomas Whiteaker and David L. Grubb of The Grubb Law Group in Charleston.
