Customers accuse Ford dealer of violating lemon law

CHARLESTON — An Ohio County couple is suing Ford and a dealer, alleging violation of the lemon law.

James Heath and Lisa Heath filed a complaint March 12 in Kanawha Circuit Court against Ford Motor Company and Jim Robinson Ford-Lincoln Inc., alleging they violated the Magnuson-Moss Warranty Act.

According to the complaint, on Aug. 22, 2016, the Heaths purchased a 2016 Ford F150, which was accompanied by manufacturer's warranty. After purchase, the suit says, the Heaths experienced repeated nonconformities with the vehicle that substantially impaired its use, value and safety. 

The Heaths say they suffered monetary loss, loss of use of the vehicle, emotional and mental distress and inconvenience. 

The plaintiffs allegesdespite repeated attempts to repair the vehicle, the defendants failed to bring it into conformity with its warranties and failed and refused to provide a comparable vehicle.

The Heaths seek trial by jury, damages, costs, attorney fees, pre- and post-judgment interest and all other general and appropriate relief. They are represented by attorneys Kristina Thomas Whiteaker and David L. Grubb of The Grubb Law Group in Charleston.
