Former employee accuses Lowe's of discrimination

CHARLESTON — A St. Albans woman is suing Lowe's Home Center alleging age, gender and disability discrimination.

Vicki L. Flatt filed a complaint on March 12, in the Kanawha Circuit Court against Lowe's Home Center LLC and Michael Dorsey, alleging violation of the West Virginia Human Rights Act.

According to the complaint, Flatt began working for Lowe's in September 2008. The suit says in November 2016, Flatt was diagnosed with lung cancer and was placed on FMLA leave. Due to her health issues and intermittent FMLA leave, the lawsuit says, Flatt was not placed in a new position and was terminated on or about Feb. 28, 2018. The suit says Flatt was told there was concern a higher position would "tire her out." 

As a result, Flatt says she has suffered lost wages and benefits, extreme emotional distress, embarrassment and anxiety. The plaintiff alleges Lowe's Home Center and Dorsey denied her any other management positions for which she was qualified and terminated her employment and replaced her with less-qualified younger employees.

Flatt seeks trial by jury, compensatory and punitive damages, attorney fees, court costs, interest and all other just and proper relief. She is represented by attorney Karl Kolenich of Klie Law Offices PLLC in Buckhannon.
