Logan County landowner accuses oil, gas well operator of negligence

LOGAN — A Logan County surface owner is suing an oil and gas well operator, alleging negligence and trespassing.

Greg Blevins filed a complaint March 12 in Logan Circuit Court against NYTIS Exploration Company Inc., alleging failure to take reasonable and necessary steps to prevent a water runoff problem.

According to the complaint, on Feb. 18, due to NYTIS' negligent draining, Blevins real property at the Oneida Baptist 3R well in Logan County sustained significant runoff water damage. The plaintiff says he suffered diminution in value and loss of enjoyment of the property, annoyance and inconvenience. 

The plaintiff alleges NYTIS Exploration failed to drain rainfall water in a direction that does not adversely affect his property.

Blevins seeks trial by jury, monetary relief of $75,000 and all other proper and just relief. He is represented by attorney Robert B. Kuenzel of Kuenzel Law PLLC in Chapmanville.
