MOUNDSVILLE — A former Harrison County resident is suing a retail store operator, alleging insufficient measures were taken to prevent injuries.
Jimmy Howard of San Bernadino County, California, who requires a wheelchair, filed a complaint March 12 in Marshall Circuit Court against Big Lots Stores Inc., alleging failure to provide a safe place to shop.
According to the complaint, on June 30, 2017, Howard was a guest at the defendant's store in Bridgeport. The suit says Howard was utilizing the wheelchair provided by Big Lots when its footrest broke.
Howard says he suffered a sprained ankle, contusion and a sprained back, plus medical expenses, embarrassment and emotional distress. The plaintiff alleges Big Lots Stores failed to properly maintain the wheelchair.
Howard seeks trial by jury, compensatory and general damages, pre- and post-judgment interest, and all other general and specific relief. He is represented by attorneys David Goodard and Edmund Wagoner of Goddard & Wagoner PLLC in Clarksburg.
