Marshall County couple alleges energy company created nuisance

MOUNDSVILLE — A Marshall County husband and wife are suing an oil and gas well operator, alleging creating a private nuisance, negligence and reckless conduct.

Daniel J. Lilley and Danielle D. Lilley of Proctor filed a complaint March 16 in Marshall Circuit Court against Williams Ohio Valley Midstream LLC, alleging the oil and gas well operators failed to maintain a quiet environment.

According to the complaint, as a result of Williams Ohio-Valley's reckless and outrageous conduct, the Lilleys have suffered sleeplessness, loss of enjoyment of their property, annoyance, inconvenience, anxiety and diminished value of their property at 906 Campbell Lane, Proctor. 

The plaintiffs allege Williams Ohio Valley Midstream negligently caused an unreasonable amount of noise and light pollution throughout the day and night as part of its oil and gas operations.

The Lilleys seek trial by jury, a permanent injunction enjoining the defendant from operating its facilities until the sound and light is suppressed, compensatory and punitive damages, with interest, attorney fees, court costs and all other just and proper relief.
